1. Definitions

 

 

• “We”, “Us”, “Our” refers to [Arkon Landscape Design Companyt] Ltd.

• “Client”, “You” refers to the person or entity purchasing services.

• “Services” refers to garden / landscape design, visualisation, and associated design documentation.

• “Designs” refers to all drawings, plans, renders, models, and visual content produced.

 

 

 

 

2. Scope of Services

 

 

2.1 We provide design-only services.

2.2 We do not provide construction, landscaping, engineering, surveying, drainage, or structural services.

2.3 Our designs are conceptual and visual planning tools, intended to assist decision-making and communication with contractors.

2.4 The Client is responsible for appointing suitably qualified contractors and professionals to review, validate, and implement the designs.

 

 

 

3. No Construction or Technical Liability

 

 

3.1 We are not responsible for:

 

• Structural integrity

• Ground conditions

• Drainage performance

• Planning permission

• Building regulations compliance

• Material availability or cost changes

 

 

3.2 All dimensions, levels, and materials must be verified by contractors prior to construction.

 

 

 

4. Payment Terms

 

 

4.1 All prices are quoted in GBP unless stated otherwise.

4.2 A deposit of 50% (or 100% for smaller packages) is required to secure a project slot.

4.3 No work will commence until payment has been received and cleared.

4.4 The remaining balance is due upon final design delivery.

4.5 Late payments may delay delivery.

 

 

 

5. Revisions

 

 

5.1 Each package includes a defined number of revisions as stated at the time of purchase.

5.2 A revision is defined as a reasonable modification to the agreed design direction.

5.3 Significant changes to scope, style, or layout after approval may be treated as additional work and charged accordingly.

5.4 Unlimited revisions (where offered) apply within the original agreed scope only.

 

 

 

6. Delivery Timelines

 

 

6.1 Delivery timelines are estimates, not guarantees.

6.2 Delays caused by missing information, late feedback, or scope changes are not our responsibility.

6.3 We are not liable for delays caused by third parties or force majeure events.

 

 

 

7. Client Responsibilities

 

 

The Client agrees to:

 

• Provide accurate information, measurements, and site details

• Confirm requirements clearly at onboarding

• Review designs promptly

• Seek professional advice before construction

 

 

Failure to do so may impact outcomes and timelines.

 

 

 

8. Intellectual Property

 

 

8.1 All designs remain the intellectual property of [Arkon Landscape Design Company] Ltd until full payment is received.

8.2 Upon full payment, the Client is granted a non-exclusive, non-transferable licence to use the designs for their specific property only.

8.3 Designs may not be resold, reproduced, or reused for other properties without written permission.

 

 

 

9. Use of Overseas Designers

 

 

9.1 We may use trusted third-party designers and specialists to deliver services.

9.2 All work is quality-controlled internally before delivery to the Client.

9.3 We remain the Client’s sole point of contact.

 

 

 

10. Refunds & Cancellations

 

 

10.1 Due to the bespoke nature of design services, payments are non-refundable once work has commenced.

10.2 If a project is cancelled by the Client after work has started, no refund will be issued.

10.3 If we are unable to deliver the agreed services, our liability is limited to a refund of fees paid.

 

 

 

11. Limitation of Liability 

 

 

11.1 Our total liability shall not exceed the total fees paid for the services.

11.2 We are not liable for:

 

• Indirect or consequential losses

• Loss of profit

• Construction errors

• Contractor interpretation of designs

 

 

11.3 The Client accepts that design outcomes are subjective and aesthetic preferences may vary.

 

 

 

12. Professional Indemnity

 

 

12.1 We maintain professional indemnity insurance appropriate to our services.

12.2 This does not extend to construction or contractor performance.

 

 

 

13. Force Majeure

 

 

We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to illness, system failures, supply issues, or acts of God.

 

 

 

14. Marketing & Portfolio Use

 

 

14.1 We reserve the right to use anonymised designs, visuals, and completed projects for marketing and portfolio purposes.

14.2 Client details will never be disclosed without consent.

 

 

 

15. Termination

 

 

15.1 We reserve the right to terminate services if:

 

• Payments are not made

• The Client acts unreasonably or abusively

• The scope changes beyond what was agreed

 

 

 

 

16. Governing Law

 

 

16.1 These Terms & Conditions are governed by the laws of England and Wales.

16.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

 

 

17. Acceptance

 

 

Payment of any invoice issued by [Arkon Landscape Design Company] Ltd constitutes full acceptance of these Terms & Conditions.
